Terms of Service

These terms are an agreement between you and Mako Logics LLC ("we", "us") governing your use of MakoPulse at makopulse.com. By creating an account or using the service, you accept them. They're written in plain English on purpose — but they're still binding.

1. What MakoPulse is

MakoPulse monitors websites, servers, and scheduled jobs you configure, and notifies you when they misbehave. It includes uptime checks from multiple regions, browser-based checks, SSL and domain-expiry monitoring, heartbeat monitoring, incident management with AI-generated analysis, alerting by e-mail, SMS, and voice call, and public status pages.

2. Your account

• You must provide a real e-mail address you control and keep your password secure.
• You're responsible for everything that happens under your account and workspace.
• One person or organization per workspace; team members are invited through the app.

3. Acceptable use

• Only monitor what you're allowed to monitor. You may point monitors at sites and services you own, operate, or have explicit permission to check. Using MakoPulse's probes against third-party targets without authorization is prohibited and grounds for immediate termination.
• No attempting to overload, probe, or interfere with the service itself or other tenants.
• No illegal content on status pages, and no use of alerting to harass anyone.
• We enforce fair-use limits (monitor counts, check frequency, alert volume) per your plan; we may throttle abusive patterns to protect the platform.

4. Private beta access

• MakoPulse is currently an invite-only private beta. Access is granted by invitation, free of charge, and nothing is offered for sale; there is no public signup and no self-serve purchase.
• Beta access, its limits (monitor counts, check frequency, features), and the beta itself may be changed or withdrawn at our discretion. We'll give reasonable notice where practical.
• If paid plans are introduced later, they'll come with their own pricing and billing terms — nothing will be charged without your explicit agreement. Any legacy subscription from before the beta can be managed or cancelled through the billing portal in Settings.

5. SMS and voice-call alerts

• What they are. MakoPulse Alerts is the text-message and voice-call program Mako Logics LLC runs for MakoPulse. It sends one kind of message: a notice that a monitor you (or your workspace) set up has gone down, and a follow-up when it recovers. We never send marketing texts.
• How you opt in. You add your own mobile number on the On-call page and tick the box agreeing to receive automated alert texts and calls at that number; the number cannot be saved without it. You then switch on SMS or voice alerts for the monitors you choose. Consent is never a condition of using MakoPulse or buying anything. The MakoPulse Alerts program page shows the opt-in form.
• How often. Message frequency varies with how often your monitors go down and come back. A quiet month may bring none; an outage brings one text when it starts and one when it ends, per monitor.
• Cost. Message and data rates may apply, depending on your mobile plan.
• Stopping them. Reply STOP to any alert text to stop all texts from us immediately. You can also switch SMS off in the app or remove your number. Reply HELP for help, or e-mail support@makopulse.com.
• Delivery. Mobile carriers are not liable for delayed or undelivered messages. Because alerts can be blocked or delayed by carriers, never rely on SMS as your only alert channel.
• How we handle your phone number is covered in our Privacy Policy. We do not share it with anyone for marketing.

6. The honest disclaimer

MakoPulse is a monitoring tool, not an insurance policy. We work hard to make checks and alerts reliable, but we cannot guarantee that every check runs, every alert is delivered, or every problem is detected — e-mail providers filter, phone carriers block, networks fail, and third-party services we depend on have outages of their own. AI-generated diagnoses and post-mortems are automated analysis and can be wrong; verify before acting on them. The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose.

7. Limitation of liability

To the maximum extent permitted by law, Mako Logics LLC is not liable for indirect, incidental, special, or consequential damages — including lost revenue, lost data, or losses caused by downtime we failed to detect or alerts that didn't arrive. Our total liability for any claim related to the service is capped at the amount you paid us in the twelve months before the claim arose, or $50 if you haven't paid us anything.

8. Termination

You can delete your account whenever you like. We may suspend or terminate accounts that violate these terms, abuse the platform, or create legal risk — with notice where practical, immediately where necessary. On termination, your data is deleted per our Privacy Policy.

9. Changes to the service and terms

We ship improvements constantly and may add, change, or retire features. If we make a material change to these terms, we'll update the date above and note it on the dashboard; continued use after that means you accept the new terms.

10. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts of Montgomery County, Texas.
