Terms of Service

These terms are an agreement between you and Mako Logics LLC ("we", "us") governing your use of MakoPulse at makopulse.com. By creating an account or using the service, you accept them. They're written in plain English on purpose — but they're still binding.

1. What MakoPulse is

MakoPulse monitors websites, servers, and scheduled jobs you configure, and notifies you when they misbehave. It includes uptime checks from multiple regions, browser-based checks, SSL and domain-expiry monitoring, heartbeat monitoring, incident management with AI-generated analysis, alerting by e-mail, SMS, and voice call, and public status pages.

2. Your account

• You must provide a real e-mail address you control and keep your password secure.
• You're responsible for everything that happens under your account and workspace.
• One person or organization per workspace; team members are invited through the app.

3. Acceptable use

• Only monitor what you're allowed to monitor.You may point monitors at sites and services you own, operate, or have explicit permission to check. Using MakoPulse's probes against third-party targets without authorization is prohibited and grounds for immediate termination.
• No attempting to overload, probe, or interfere with the service itself or other tenants.
• No illegal content on status pages, and no use of alerting to harass anyone.
• We enforce fair-use limits (monitor counts, check frequency, alert volume) per your plan; we may throttle abusive patterns to protect the platform.

4. Plans and billing

• The Free plan is free forever within its limits and requires no card.
• Pro is billed monthly through Stripe at the price shown on our pricing page at the time you subscribe. Taxes may apply depending on your location.
• You can cancel anytime through the billing portal in Settings; your plan stays active until the end of the paid period, then drops to Free. Amounts already paid aren't refunded, except where the law requires it.
• If a payment fails and stays failed, we may downgrade the workspace to Free.
• We may change prices with at least 30 days' notice; changes apply from your next billing cycle.

5. The honest disclaimer

MakoPulse is a monitoring tool, not an insurance policy. We work hard to make checks and alerts reliable, but we cannot guarantee that every check runs, every alert is delivered, or every problem is detected — e-mail providers filter, phone carriers block, networks fail, and third-party services we depend on have outages of their own. AI-generated diagnoses and post-mortems are automated analysis and can be wrong; verify before acting on them. The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose.

6. Limitation of liability

To the maximum extent permitted by law, Mako Logics LLC is not liable for indirect, incidental, special, or consequential damages — including lost revenue, lost data, or losses caused by downtime we failed to detect or alerts that didn't arrive. Our total liability for any claim related to the service is capped at the amount you paid us in the twelve months before the claim arose (or $50 if you're on the Free plan).

7. Termination

You can delete your account whenever you like. We may suspend or terminate accounts that violate these terms, abuse the platform, or create legal risk — with notice where practical, immediately where necessary. On termination, your data is deleted per our Privacy Policy.

8. Changes to the service and terms

We ship improvements constantly and may add, change, or retire features. If we make a material change to these terms, we'll update the date above and note it on the dashboard; continued use after that means you accept the new terms.

9. Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts of Montgomery County, Texas.
